General Terms and Conditions. For the hotel industry
I. Scope, Conclusion of Contract
The Hall-Wattens Region Tourist Board acts as an intermediary in its business relationship with a booking customer. A contract is therefore concluded between the booking customer and the accommodation provider (AP). The following General Terms and Conditions, in the version valid at the time of booking, apply to this contract. Any mutual claims arising from this contract may only be asserted against the direct contracting party, and the Hall-Wattens Region Tourist Board accepts no liability or joint liability whatsoever. The Hall-Wattens Region Tourism Association shall agree with the booker that the Austrian Hotel Contract Conditions (ÖHVB) adopted by the hotel industry on 15 November 2006, as well as the supplementary General Terms and Conditions set out herein, shall apply.

II. In particular, the section entitled “Cancellations” is :
F Up to a maximum of 3 months before the booker’s agreed arrival date, both contracting parties, i.e. both the booker and the accommodation provider, may unilaterally terminate the accommodation contract without paying a cancellation fee. The notice of cancellation must be received by the other party within the specified period.
F Up to a maximum of 1 month before the booker’s agreed arrival date, the accommodation contract may be terminated by the guest subject to a corresponding cancellation fee. Here too, the notice of cancellation must be received by the other party within the specified time limit. However, a cancellation fee amounting to 40 per cent of the package price must be paid.
F In the event of cancellation up to 1 week before the arrival date, the cancellation fee is 70 per cent of the package price; within the last week, it is 90 per cent.
The Hall-Wattens Region Tourist Board will offer the person making the booking cancellation insurance for every booking. The premium is payable by the person making the booking.
III. Supplementary General Terms and Conditions:
1. The contracting parties agree that Austrian law shall govern both the accommodation contract and the agency contract.
2. No ancillary agreements have been made.
3. Any amendments or additions to this contract must be made in writing to be legally valid.
4. It is agreed that the District Court of Windischgarsten shall have jurisdiction over any disputes arising from this legal transaction – including disputes concerning the validity of the legal transaction itself.
5. The place of performance for the services provided by the Hall-Wattens Region Tourist Board is the town of Hall.
6. The accommodation provider expressly confirms that the Austrian Hotel Contract Conditions are legally binding for all bookings; furthermore, the accommodation provider declares that it is fully acquainted with the General Terms and Conditions, has received a copy thereof, and accepts them in their entirety for every booking.
7. The Hall-Wattens Region Tourist Board processes personal and business-related data in compliance with the applicable data protection laws. The data received is collected, processed and used exclusively to the extent necessary for the establishment, structuring or amendment of its own business relationships as well as any brokered business relationships. The Hall-Wattens Region Tourist Board is entitled to pass this data on to partners commissioned by the Hall-Wattens Region Tourist Board, insofar as this is necessary to process reservation enquiries or bookings. Furthermore, provided the guest has given their express consent, the Hall-Wattens Region Tourist Board is entitled to collect, process and use the data received from the guest for the purposes of providing advice, advertising, market research and tailoring offers to guests’ needs.
8. No guarantee is given as to the accuracy of the content of the image material provided by the accommodation providers.
